The case cited by Fair Work Australia President Justice Iain Ross in arguing Fair Work Australia should be renamed has been dismissed by a full bench, ending an extension of time bid by a "functionally illiterate and brain damaged" gardener who mistakenly lodged his unfair dismissal claim with the Fair Work Ombudsman rather than the industrial tribunal.
