Full court upholds reinstatement of worker sacked for “golden rule” safety breach

A full bench of the Federal Court has today rejected a Rio Tinto subsidiary’s bid to overturn the reinstatement of a Hunter Valley mineworker sacked over a safety breach, in a ruling that provides guidance for practitioners on the grounds for arguing for permission to appeal unfair dismissal decisions.
